Our Process
At Newsom Legal, civil law cases are approached with a meticulous, strategic, and results-oriented mindset. Whether it involves contract disputes, damages, liability claims, property issues, or debt collection, our team thoroughly analyzes each situation and develops a legal solution tailored to the client’s needs. Our process consists of four essential stages:
Planning The Case
From the beginning, the legal team meets with the client to understand the facts, the goals, and the possible legal paths. An initial strategy is established, which may include negotiation, mediation, or litigation.
Example: In a breach of contract case between two companies, the client needed a quick resolution to avoid business disruption. During the planning phase, we prioritized an out-of-court settlement to reach a swift agreement.
Evaluate Situation
At this stage, all relevant documents are reviewed: contracts, emails, receipts, witness accounts, etc. Legal risks are identified, the viability of the claim or defense is analyzed, and potential damages or compensation are calculated.
Example: In a claim for property damage caused by water leaks in an apartment, we reviewed the lease agreement and technical reports, finding that the liability fell on the building’s management, not the tenant.
Gather More Information
This phase involves collecting further evidence: expert reports, notarized statements, photographs, previous contracts, and more. The client's position is strengthened with clear and solid documentation.
Example: In a dispute over a right-of-way, we obtained cadastral maps and witness statements from neighbors confirming the traditional use of the path—key evidence that supported our client’s claim.
File The Case To The Court
With a refined strategy and all necessary evidence in hand, we file the appropriate claim, response, or appeal. We defend the client's interests in each hearing, aiming for a favorable ruling or, when possible, a negotiated resolution.
Example: In a personal injury lawsuit after an accident in a commercial establishment, we presented medical reports, witness testimony, and security footage. The evidence was so compelling that the court ruled in our favor without requiring an appeal.
